CareRanks Claim Program — Terms of Service
These Terms govern the CareRanks listing-claim program (the "Program"), operated by InfoBakery LLC ("CareRanks," "we") at portal.careranks.com. By claiming a listing or submitting content, you agree to them.
1. Definitions
"Facility" — a provider listed on careranks.com from federal datasets. "Organization" — the legal entity operating a Facility (or its parent or authorized management company). "Claimant"/"you" — the individual acting for an Organization. "Submitted Content" — anything you provide through the Program: logos, statements, corrections, and any later content types.
2. Eligibility and authority
You represent that you are an employee or authorized agent of the Organization for each Facility you claim, with authority to bind it to these Terms. Management companies and health systems must hold written authorization from the Organization and provide it on request. Claiming a Facility you are not authorized to manage is a material breach; we may revoke such claims and remove their content at any time.
3. Verification
We verify claims using signals including email-domain match against a Facility's website of record, one-time codes, calls to the Facility's number on file, and written authorization. Every claim is reviewed by CareRanks staff before approval. We may re-verify at any time and may revoke claims that fail re-verification. Verification confirms listing control only; it is not an endorsement, credential, or license check.
4. License to Submitted Content
You grant CareRanks a non-exclusive, worldwide, royalty-free license to host, reproduce, display, and reformat Submitted Content on CareRanks properties for operating the Program, with the right to retain archival copies for records and integrity purposes after removal. You retain ownership. You represent that you hold all rights needed to grant this license (including trademark rights in logos and consent for any depicted persons or premises).
5. Accuracy and substantiation
Submitted Content must be true, current, and substantiated. Certifications, designations, and awards may be stated only if presently held and issued by the named body. We may require substantiation and may remove content pending it.
6. Content rules; no PHI
Submitted Content must comply with the published content rules (careranks.com/about/claiming-policy), which are incorporated into these Terms and may be updated prospectively. In particular, Submitted Content must contain no patient information of any kind (including stories, images, testimonials, or information that could identify a patient). If protected health information is nonetheless submitted, you must notify us immediately; we will delete it from the Program's systems and published surfaces, retaining only what law requires. The Program is not a HIPAA business-associate relationship and must never be used to transmit PHI.
7. Review, publication, and removal
All Submitted Content is reviewed by CareRanks staff before publication. Review checks conformance to the content rules — it is not verification of your claims, and published content is labeled as supplied by the Organization and not written or verified by CareRanks. We may reject, edit-for-format, decline to publish, or remove any Submitted Content at any time, with or without notice, and are under no obligation to publish anything. Statements carry the date provided; we may retire content that is no longer current or re-attested.
8. Independence of ratings (non-negotiable)
Nothing in the Program affects, and nothing you submit or spend can ever affect, any CareRanks rating, grade, quality measure, price figure, or ordering. Ratings and grades derive from public federal data under our published methodology, identically for claimed and unclaimed Facilities. Participation confers no right to influence editorial treatment; disputes about CMS-derived data go through the public corrections process available to everyone.
9. Term, termination, transfers
Either party may end a claim at any time (you: unclaim in the portal; us: revocation under these Terms). On termination we remove the Organization's supplied content from future site builds within a commercially reasonable period. Facility closures, decertifications, CCN changes, and ownership transfers may end or transfer a claim; successor operators must claim and verify independently.
10. Indemnity
You will defend and indemnify CareRanks against third-party claims arising from Submitted Content or your breach of these Terms, including IP, false-advertising, and privacy claims.
11. Disclaimers; limitation of liability
The Program is provided "as is." To the maximum extent permitted by law, CareRanks's aggregate liability arising from the Program is limited to one hundred US dollars (the Program is free); neither party is liable for indirect or consequential damages. Nothing limits liability that cannot be limited by law.
12. Compliance
You represent that the Organization and Claimant are not subject to US sanctions and that participation complies with applicable law, including state advertising law. Government and VA facilities may participate in the free Program; their participation confers no commercial relationship.
13. Records
We keep records of claims, verifications, submissions, review decisions, and communications for integrity and audit purposes.
14. Changes; governing law
We may update these Terms prospectively with notice in the portal; continued use is acceptance. Connecticut law governs; exclusive venue is the state and federal courts of Connecticut.
